CAMPGROUND WAIVER OF LIABILITY, RELEASE, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

In consideration of being permitted to enter, stay at, and use the facilities, amenities, and premises of Forest Camps (hereinafter referred to as the “Campground”), including but not limited to campsites, roads, trails, restrooms, showers, recreational areas, water access, fire pits, and any activities offered or occurring on the property, the undersigned (“Camper” or “Guest,” which includes all adults, minors, and guests in the party) agrees as follows:
1. Acknowledgment and Assumption of Risk
I understand and acknowledge that camping and outdoor recreational activities involve inherent and significant risks of serious bodily injury, property damage, emotional distress, or death. These risks include, but are not limited to:
Slips, trips, and falls on uneven terrain, rocks, roots, mud, or wet surfaces
Injuries from wildlife, insects, or plants
Exposure to severe weather, lightning, high winds, flooding, or extreme temperatures
Fire-related risks from campfires, grills, or cooking equipment
Water-related hazards if near rivers, lakes, or coastal areas (drowning, currents, slippery rocks)
Vehicle and traffic accidents on campground roads
Theft, vandalism, or damage to personal property, tents, RVs, or vehicles
Illness or allergic reactions
Any risks associated with my own negligence or the negligence of other guests
I voluntarily assume all risks, known and unknown, associated with my stay and activities at the Campground, even if caused in whole or in part by the negligence of the Campground or its staff.
2. Release and Waiver of Liability
I, on behalf of myself, my heirs, executors, administrators, assigns, and next of kin, hereby fully release, waive, discharge, and covenant not to sue Forest Camps, its owners, operators, managers, employees, agents, affiliates, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action whatsoever, including but not limited to claims for negligence, arising out of or related to my presence at or use of the Campground.
This release includes, without limitation, any injury, death, or property damage that may result from the Campground’s ordinary negligence, conditions on the premises, equipment provided, or activities conducted on the property.
3. Indemnification and Hold Harmless
I agree to indemnify and hold harmless the Released Parties from any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising from my acts, omissions, or presence at the Campground, including any claims brought by third parties or my guests/family members.
4. Additional Agreements, I agree to abide by all Campground rules, policies, and safety instructions. Failure to do so may result in immediate eviction without refund.
I am responsible for the safety and supervision of all minors in my party at all times.
I authorize the Campground to seek emergency medical treatment for me or members of my party if needed, and I agree to pay all associated costs.
This agreement is binding for the entire duration of my stay and any future visits.
If any portion of this agreement is held invalid, the remainder shall continue in full force and effect.
I have carefully read this entire agreement, fully understand its terms, and sign it voluntarily. I am at least 18 years of age and legally competent to sign. If signing on behalf of a minor, I represent that I am the parent or legal guardian and agree to all terms on their behalf.
